Court orders framing of charges against Renuka

NEW DELHI: A city court has ordered framing of charges against tourism minister Renuka Choudhary in a 12-year-old case.

Choudhary was accused of beating up a traffic cop who stopped her from taking a road which was closed due to security reasons for the PM’s motorcade. The court has fixed March 15 for framing of charges.

“A prima facie case under Sections 332 (voluntarily causing hurt to deter public servant from his duty) and 353 (assault or criminal force to deter public servant from discharge of his duty) of IPC is made out against Renuka Choudhary,” it said.

Renuka Choudhary fails to get relief in assault case

New Delhi: Union Tourism Minister Renuka Choudhary, facing charges of assaulting a police constable in New Delhi 11 years ago, has failed to get any relief from a Delhi court which refused to recall the summon issued to her.

Citing a recent Supreme Court judgement, Metropolitan Magistrate (MM) Siddharth Sharma said that Magistrates do not have the power to recall their summoning order.

The court has now fixed February 9 for hearing arguments on the charges to be framed.

Delhi Police had registered a case against Choudhary, then a Rajya Sabha member of the Telugu Desam Party (TDP), on January 20, 1993, for allegedly assaulting a Head Constable who was on duty along the then Prime Minister’s route.

The FIR registered at Chanakyapuri police station said that traffic was being diverted at the Teen Murti Marg-Kautilya Marg-Shanti Path intersection that day as the Prime Minister’s convoy was scheduled to pass along.

At that time Choudhary came there driving a Contessa car. She refused to heed the police advice. Instead she got out of the car and “kicked and slapped” Head Constable Janaki Ram, who had asked her to stop the vehicle, the FIR alleged. Later on, learning that she was an MP, police had allowed her to go.

In May 1993, police filed a chargesheet against her, but a Metropolitan Magistrate declined to accept it unless Choudhary was arrested.

Police moved the Sessions Court against the MM’s order and on July 13, 2000, the same was set aside and the case sent back to MM’s court, which took cognizance of the chargesheet and summoned her.

Assault case: Renuka Chowdhary discharged

A Delhi court today discharged Union Tourism Minister Renuka Chowdhury in an assault case.

The verdict came twelve years after Chowdhury allegedly beat up a police personnel for stopping her on a route through which the Prime Minister was to pass.

In a major relief to Chowdhury, Additional Sessions Judge D S Paweriya allowed the revision petition filed by her.

Period of limitation

He set aside Metropolitan Magistrate Siddharth Sharma’s February 9 order to frame charges against the Union Minister saying the Magistrate “has committed illegality by taking cognizance of the case without condoning the delay….

“Accordingly, his order directing framing of charges against Chowdhury is set aside with the observation that chargesheet was filed after period of limitation, cognizance of which could not have been taken in the absence of delay explained by prosecution or condonation of delay by a concerned court”.

Prima facie case

The Magistrate had earlier said that a prima facie case under Sections 332 (voluntarily causing hurt to deter public servant from his duty) and 353 (assault or criminal force to deter public servant from discharge of his duty) of IPC was made out against the Union Minister.

On January 20, 1993, Assistant Sub Inspector Suraj Mal, posted on the route at Kautilya Marg near Teen Murti on which the Prime Minister was to pass, had detained Chowdhury’s car.

Chowdhury then got down from the car, quarreled with Head Constable Janki Ram, also on duty, and abused him besides giving him fist blows and kicks, thereby, obstructing him from performing his duty, they alleged. (PTI)

      No, I understand “security reasons”. I don’t understand justification in closing a road because of that. Like seriously, to me the Prime Minister has no more right have a road closed down for him than I do. He is no greater a citizen of the country than I am. And the road being public property, it should not be closed for the “security” of one person.
